1. Introduction
Welcome to DreamLikeAI. These Terms of Service ("Terms") govern your use of the DreamLikeAI website and services provided by KoinWatch Co. Ltd. By accessing or using our services, you agree to comply with these Terms.
2. Use of Services
DreamLikeAI provides tools for creating and generating AI-driven music. Users must register for an account to access certain features. You are responsible for maintaining the confidentiality of your account and password and for all activities under your account.
3. License to Use
DreamLikeAI grants you a non-exclusive, non-transferable, revocable license to use our platform for personal and business purposes, as long as you comply with these Terms. All intellectual property rights in the services and materials we provide remain the property of KoinWatch Co. Ltd. or our licensors.
4. Responsible Use of AI Music Generation
Original Music Only: DreamLikeAI provides AI tools for the creation of original music. You may not use our AI to generate music intended to replicate, copy, or infringe upon existing copyrighted works.
Prohibited Conduct: Any attempts to use DreamLikeAI’s services for the creation of music that violates copyright law or other intellectual property rights, or that could be deemed offensive or disruptive to the community, will result in the immediate termination of your account. There is zero tolerance for such actions.
Automatic Detection: DreamLikeAI employs measures to detect and prevent the creation of content that closely mirrors copyrighted music. However, you are ultimately responsible for ensuring that any music created using our AI complies with copyright laws and does not infringe upon any third-party rights.
User Responsibility: If you create or attempt to create music that is, or could reasonably be interpreted as, a reproduction of copyrighted works, you must delete the music immediately and report it to us at support@dreamlikeai.com. You are responsible for ensuring your content does not violate any laws, and DreamLikeAI disclaims liability for user-generated content, even in cases where our detection systems do not identify violations.
While DreamLikeAI uses sophisticated AI detection systems, it cannot guarantee full accuracy in identifying copyright violations. Users bear full legal responsibility for any content created on the platform.
5. User Content
By uploading or submitting content (such as music, lyrics, etc.) to DreamLikeAI, you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, and distribute your content for the purpose of providing our services. You retain all ownership rights in your content. However, you agree that any content generated using our platform that violates these Terms, especially in relation to intellectual property violations, is your responsibility.
6. Payment and Fees
For certain services, DreamLikeAI may charge fees. Payment details, including pricing and subscription options, will be provided at the time of purchase. Fees are non-refundable unless otherwise specified.
Payments for DreamLikeAI services are processed through Stripe, a third-party payment provider. By using our services, you agree to Stripe's Terms of Service and acknowledge that DreamLikeAI is not responsible for any errors, delays, or failures in payment processing attributable to Stripe.
7. Data and Privacy
We collect and process your personal data as outlined in our Privacy Policy. By using DreamLikeAI, you agree that your data may be transferred and stored in Singapore and that we may process your information for purposes outlined in the Privacy Policy.
Upon account termination or deactivation, user data will be retained for 2 days before permanent deletion, unless required otherwise by law.
8. Termination
We may suspend or terminate your access to DreamLikeAI if you violate these Terms or for any other reason, at our sole discretion. Attempting to create copyrighted or infringing material will lead to immediate account termination.
9. Disclaimer of Warranties
DreamLikeAI is provided "as-is" and without warranties. While we strive to offer a reliable service, we do not guarantee that the platform will be error-free or uninterrupted. Some jurisdictions do not allow disclaimers of certain warranties, so these limitations may not apply to you.
DreamLikeAI makes no guarantees regarding uptime or the availability of services. Downtime may occur due to third-party service interruptions, scheduled maintenance, or unforeseen technical issues.
10. Limitation of Liability
KoinWatch Co. Ltd. will not be liable for any indirect, incidental, special, or consequential damages arising out of your use of DreamLikeAI. We are not responsible for any user-generated content that violates intellectual property rights or any applicable laws. You assume all responsibility for ensuring that your content complies with the law.
User Responsibility: You are solely responsible for any legal liabilities arising from your use of AI-generated music. In the event that our software does not detect copyright infringement or the AI inadvertently generates music similar to existing works, you must delete and cease use of that content and report it to us immediately. By using DreamLikeAI, you agree to indemnify KoinWatch Co. Ltd. against any legal claims resulting from your content.
You agree to indemnify, defend, and hold harmless KoinWatch Co. Ltd., its affiliates, and its licensors from and against all claims, damages, losses, and expenses (including attorneys' fees) arising from or related to your use of the services or violation of these Terms.
11. Third-Party Services
DreamLikeAI relies on third-party services, including but not limited to Stripe for payment processing and other suppliers for AI-generated music. While we strive to maintain uninterrupted services, we are not responsible for any disruptions, delays, or outages caused by these third-party services. You acknowledge that DreamLikeAI may not be available at all times due to the unavailability of third-party services. We shall not be liable for any loss or damage arising from such interruptions.
12. Confidentiality
Users agree not to disclose, reproduce, or communicate any proprietary or confidential information related to DreamLikeAI, including but not limited to the identity of its suppliers or internal systems, without prior written consent. Violation of this clause may result in account termination and legal action.
13. Force Majeure
DreamLikeAI shall not be liable for any failure to perform due to causes beyond its reasonable control, including but not limited to acts of God, fire, war, government regulations, labor disputes, power failures, or third-party service disruptions (e.g., payment processing, music generation tools, etc.). In such cases, DreamLikeAI reserves the right to suspend services until the issue is resolved.
14. Dispute Resolution
Any disputes arising under these Terms will be resolved exclusively through final and binding arbitration, except for claims that may be brought in small claims court, provided the claims meet the small claims court's requirements.
Arbitration will take place in Bangkok, Thailand, or another location chosen solely at the discretion of KoinWatch Co. Ltd., unless both parties mutually agree on another location. If no mutual agreement is reached, arbitration will proceed in Bangkok.
15. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will notify you via email or through our platform. Your continued use of DreamLikeAI after such changes will constitute your acceptance of the updated Terms.
